Appellate Practice

Appellate practice, like other areas of the law, is a specialty.  It requires a familiarity with a set of rules different from those involved in the trials of civil or criminal cases.  The presentation of a case on appeal, from the filing of the notice of appeal, through motions, briefing and argument, requires knowledge of specialized rules and procedures and demands advocacy skills separate and distinct from those required to try a case.

R|S has substantial appellate experience, having practiced before numerous state and federal appellate courts throughout the United States. Our firm has handled both civil and criminal appeals, and is adept at achieving results on appeal which reverse adverse decisions or protect positive results obtained in the trial court. The attorneys in our firm are often called upon to assist other law firms in appealing adverse judgments against their clients. As a result of our firm's extensive trial skills, our firm is adept at recognizing appellate issues, presenting them in a straight forward manner which highlights the errors made in the trial court and demonstrates how the errors affected the judgment below. R|S attorneys have the skills necessary to make the difference on appeal, by framing the appellate issues in the most persuasive manner possible and by arguing our clients' case simply, forcefully and effectively. The attorneys at R|S are available to handle or to assist in any appeal in which a client may be involved.  We are frequently called upon after the trial of a case to take or defend an appeal.  We also are available to assist current counsel in perfecting and litigating a case on appeal.

R|S attorneys have appeared in matters before the U.S. Supreme Court, the U.S. Court of Appeals for the Third, Sixth, and Seventh Circuit, and before numerous state appellate courts of all levels, in both criminal and civil matters.
