R|S wins Dismissal of 2 Lawsuits on behalf of NBA Superstar involved in Palace Brawl
On December 10, 2007, R|S obtained Summary Judgment of claims by two Plaintiffs that they were injured by NBA Superstar, Ron Artest, in the Palace "BasketBrawl" during the Nov 19, 2004 Detroit Pistons/Indiana Pacers game. The lawsuits were originally filed in the Oakland County Circuit Court and later re-filed in the United States District Court for the Eastern District of Michigan. In one of the lawsuits, a fan claimed that he suffered a concussion and other injuries after Mr. Artest entered the stands. In the other lawsuit, a second Plaintiff claimed to have suffered head injuries when he was struck by another Pacer player as he was exiting the floor and blamed Mr. Artest for starting the brawl. As a result of a vigourous defense, the firm was able to convince the Court that Mr. Artest did not strike either fan, that he breached no legal duty owed to the fans and that any injuries suffered by the fans were not a foreseeable consequence of Mr. Artest’s action.
